California Homeschool Legal Challenge
Pacific Justice Institute Joins Legal Battle
Pacific Justice Institute Will Represent Sunland
Christian School before the California Supreme Court
Thanks to Annette K. Hall of LocalHS.com for advising Terry Neven of Sunland Christian School
where the Long children were enrolled in the school's Independent Study Program,
to contact the Pacific Justice Institute
(among other organizations including California Homeschool Network,
HomeSchool Association of California, and Home School Legal Defense Association)
to inquire about legal representation regarding a case titled "In re Rachel L."
in which, according to PJI "the California Court of Appeal has issued an opinion
finding no legal right to home school." Looks like Mr. Neven took her advice.
"This writ cannot be overturned by a lower court and could require a California
Supreme Court ruling in order to be overturned. ...SCS's attorneys from the Pacific
Justice Institute are moving forward to try to have the decision reversed. Appellate
writs are open for interpretation."
Runaway Teens Request For Assistance Triggers Investigation
LocalHS.com offers background information on this homeschool-impacting case
that began with a runaway teen's request for help in October of 2005.
This is a follow-up article by the Home School Legal Defense Association
HSLDA released a
statement this morning that includes this line of reassurance: "We do want to
make one point clear, however. Nothing has changed in California regarding your
homeschool. HSLDA maintains that the advice we give homeschool families is accurate
and that filing a private school affidavit, or enrollment in a private school independent
study program (I.S.P) is a valid option under the law in California."
Homefires will continue to monitor this situation and provide updates. For a
